NOTICE OF PUBLIC HEARING

WHEREAS the Town of Geneseo, in the County of Livingston, in the State of New York (the “Town”) has received a Preliminary Engineering Report / Map, Plan, and Report by MRB Group, dated July 9, 2025 (the “Report”) for the formation of a proposed water district within the Town (the “Proposed District”) pursuant to New York State Town Law Article 12.

WHEREAS the Town has received a Petition signed by (1) property owners and/or (2) resident property owners, of the taxable real property within the Proposed District pursuant to New York State Town Law Article 12 requesting the formation of said Proposed District, witnessed June 13, 2025 (the “Petition”).

WHEREAS the Town Assessor for the Town of Geneseo, New York, received the petition and will certify it, confirming that the Petition satisfies the Petition requirements for New York State Town Law Article 12 before any action is taken.

NOTICE IS GIVEN, AND IT IS HEREBY ORDERED, that on August 13, 2025 at 4:45 PM a public hearing will be held by the Town Board of the Town of Geneseo, in the County of Livingston, in the State of New York, at the Town of Geneseo offices located at 4630 Millenium Drive, Geneseo, New York 14454, to consider the establishment of a Proposed District pursuant to Article 12 of the Town Law of the State of New York.

The Proposed District is to be known as the Water District #7.

The boundaries of the Proposed District are as follows:

ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Geneseo, County of

Livingston and State of New York, designated as Geneseo Water District No. 7 and as delineated on a map prepared by MRB Group Engineering, Architecture & Surveying, D.P.C., dated March

2025, entitled “District Map and Plan” (Project No. 0110.24001) and being more particularly bounded and described as follows:

BEGINNING at a point on the municipal boundary between the Town of Geneseo and the Town of Avon in range with the eastern ROW of Avon Geneseo Road, said point being located at coordinates North 1,041,951’± and East 1,365,793’±, said point being the Point of Beginning (POB) of Geneseo Water District No. 7; thence

1. Easterly, along the existing municipal boundary between the Town of Geneseo and the Town of Avon to the point at its intersection with the existing northern boundary of Tax Map Parcel (TMP) 64.-1-10.1; thence

2. Easterly, along the existing northern boundary of TMP 64.-1-10.1, to a point at its intersection with the existing westerly boundary of TMP 64.-1-12; thence

3. Northerly along the last-mentioned westerly boundary to a point at its intersection with the existing northerly boundary of TMP 64.-1-12; thence

4. Northeasterly along the existing northern boundary of TMP 64.-1-12 to the point at its intersection with the existing municipal boundary between the Town of Geneseo and the Town of Avon; thence

5. Easterly along the existing municipal boundary between the Town of Geneseo and the Town of Avon to the point at its intersection with the existing eastern boundary of TMP 64.-1-52; thence

6. Southeasterly along the existing eastern boundary of TMP 64.-1-52 to a point at its intersection with the existing northerly highway boundary of Triphammer Road; thence

7. Easterly along the existing northerly highway boundary to a point at its intersection with the existing municipal boundary between the Town of Geneseo and the Town of Avon; thence

8. Easterly along the existing municipal boundary between the Town of Geneseo and the Town of Avon to a point at its intersection with the northerly prolongation of the western highway boundary of Pole Bridge Rd; thence,

9. Southerly along the last-mentioned existing westerly highway boundary to a point at its intersection with the existing southerly boundary of TMP 64.-1-12; thence

10. Westerly along the existing southerly boundary of TMP 64.-1-12 to a point of

intersection with the existing easterly boundary of TMP 64.-1-12; thence

11. Southerly along the last-mentioned eastern boundary to a point at its intersection with the existing southerly boundary of TMP 64.-1-12; thence

12. Westerly along the existing southern boundary of TMP 64.-1-12 to a point at its

intersection with the existing easterly boundary of TMP 64.-1-12; thence

13. Southerly along the last-mentioned existing eastern boundary to a point at its intersection with the existing southerly boundary of TMP 64.-1-12; thence

14. Westerly along the last-mentioned existing southern boundary crossing North Rd and along the existing southerly boundary of TMP 64.-1-10.1 to a point at its intersection with the existing easterly highway boundary of Elm Rd; thence

15. Northerly along the last mentioned existing easterly boundary of Elm Rd to a parcel at its intersection with the easterly extension of the existing southerly boundary of TMP 63.-1-21.12; thence

16. Westerly across Elm Rd and along the southern boundary of TMP 63.-1-21.12 to a point of intersection with the existing eastern boundary TMP 63.-1-21.12; thence

17. Southerly along the last-mentioned existing boundary of TMP 63.-1-21.12 to a point of the intersection with the existing southerly boundary of TMP 63.-1-21.12; thence

18. Westerly along the last-mentioned existing southern boundary to a point at its intersection with the existing easterly boundary of TMP 63.-1-21.12; thence

19. Southerly along the last-mentioned existing eastern boundary to a point at its intersection with the existing southern boundary of TMP 63-1-21.12; thence

20. Westerly along the last-mentioned existing southern boundary to a point at its intersection with the existing westerly boundary of TMP 63.-1-21.12; thence

21. Northerly along the last-mentioned existing western boundary to a point at its intersection with the existing southerly boundary of TMP 63.-1-17; thence

22. Westerly along the last mentioned existing southern boundary of TMP 63.-1-17    to a point at its intersection with the existing easterly highway boundary of Avon Geneseo Rd; thence

23. Northerly along the last-mentioned easterly highway boundary to the point and place of beginning.

as indicated on the map of the proposed District boundaries attached hereto as Exhibit A.

At such public hearing, the Town Board will hear all persons interested in the subject matter thereof.

All interested persons are invited to attend and be heard.
